Subject:- Notice for initiating legal action under Environmental Laws.
• Whereas, no unit can be put in operation without the mandatory/& valid consent of this Committee and without proper Pollution Control Devices/Measures as envisaged under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.
• Whereas, while examining your application for grant of Consent to Operate (Renewal) and the report submitted by DO, PCC Budgam, it has surfaced that the stone crushing unit has been found operational without adequate pollution control devices/pollution control measures.
• Whereas, operation of the unit with above status is punishable under Section-5 of the Environment (Protection) Act, 1986 which includes closure of the unit as well.
Now, therefore, in light of the above, you are hereby directed to rectify the short-comings mentioned above and submit compliance within 15-days from issuance of the present notice otherwise legal action as per law shall be initiated against the unit. In the meanwhile, your application for grant of consent to operate (renewal) cannot be considered till the short-comings quoted above are rectified.

The applicant has uploaded case related documents and deposited CF for Rs 7500/= vide online receipt dated 4/8/2022. Madam, the case for CTO (R) of Guest House at Srinagar with 50 rooms capacity has been examined and recommended by RD(K) and SC (C). Solid waste generated is handed over to SMC. STP of 25 KLD capacity with DFM's in place. Hence the case may be considered for accord of CTO (R) up to March 2027, and the CTO(R) shall be subject to strict implementation of SRO 231 on single use non-biodegradable disposables, adherence to the Notification of ban on SUP's issued vide G.S.R.571(E) Dt. 12-08-2021 by MoEF&CC, Govt of India, with the regular updating of log book to be attested by DO on monthly basis. Further it shall also be subject to implementation of recent guideline issued by CPCB for hotels / Banquet halls / Motels etc in compliance to directions of Hon’ble NGT in OA No.400, RD and DO to ensure that, please. |
